Terms of Service

1. Service Description

The AWS Compliance Snapshot Tool (the “Service”) is a web-based application provided by Tallence AG, Neue Gröningerstr. 13, 20457 Hamburg (“Provider”, “we”, “us”), that enables users to perform automated compliance scans of their Amazon Web Services (AWS) accounts.

The Service analyses AWS configurations against established security and compliance frameworks and generates reports summarising the findings.

The Service is provided free of charge.

2. User Obligations

By using the Service, you agree to:

• provide accurate and complete registration information (email, name, company, job title)
• maintain the confidentiality of your access credentials and not disclose them to third parties
• ensure that you have the necessary authorisation to grant the Service read access to the AWS accounts you register
• notify us without undue delay of any unauthorised use of your account or other security breaches
• keep your account information up to date

3. Acceptable Use

You agree not to use the Service to:

• violate any applicable laws, regulations or third-party rights
• gain unauthorised access to the Service, other accounts or connected systems
• impair or disrupt the integrity or performance of the Service or its infrastructure
• reverse-engineer, decompile or disassemble any part of the Service
• use the Service for any purpose other than the intended AWS compliance scanning
• transmit malicious code, viruses or harmful data through the Service
• use automated tools (bots, scrapers) to access the Service beyond the provided APIs

4. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, logos and documentation, remain the exclusive property of Tallence AG.

Your use of the Service does not grant you any ownership rights in the Service or its components.

You retain ownership of all data you provide to the Service, including AWS account configurations and scan results.

You grant us a limited licence to process this data exclusively for the purpose of providing the Service.

5. Limitation of Liability

The Service is provided “as is” and “as available” without any express or implied warranty.

To the extent permitted by law:

• we do not warrant that the Service will be uninterrupted, error-free or completely secure
• we do not warrant the accuracy, completeness or reliability of compliance scan results
• scan results do not constitute professional compliance advice
• we shall not be liable for indirect, incidental, special or consequential damages
• our total liability is limited to the amount you have paid for the Service in the last twelve months (if applicable)

6. Termination

You may terminate your use of the Service at any time by deleting your account through the account settings.

Upon account deletion, your personal data will be deleted in accordance with our privacy policy.

We may suspend or terminate your access to the Service if:

• you breach these Terms of Service
• your use of the Service poses a security risk or may adversely affect other users
• we are required to do so by law or regulation
• we discontinue the Service (with reasonable prior notice)

7. Data Processing

Our collection and processing of personal data is governed by our privacy policy.

By using the Service, you confirm that you have read and understood it.

The processing of personal data is generally carried out by Tallence AG as the controller.

In the context of further contractual services, processing may also take place within the framework of a data processing relationship. For business customers, we provide a corresponding data processing agreement in such cases.

8. Availability and Maintenance

We strive to maintain high availability of the Service but do not guarantee uninterrupted access.

Scheduled maintenance may result in the Service being temporarily unavailable. We endeavour to announce maintenance in advance where possible.

9. Marketing Communications

If you have consented thereto, we use your contact data to inform you about product updates, newsletters and further offers from Tallence AG.

Processing is carried out via the CRM system HubSpot, as described in our privacy policy.

Consent is voluntary and may be withdrawn at any time with effect for the future.

Use of the Service is possible regardless of consent to marketing communications.

Transactional emails (e.g. account verification, password reset or security-related notifications) are sent regardless of your marketing preferences, insofar as this is necessary for the operation of the Service.

10. Governing Law and Jurisdiction

These Terms of Service shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction shall be Hamburg, Germany, to the extent permitted by law.

11. Changes to These Terms of Service

We reserve the right to amend these Terms of Service at any time.

The current version will be published on this page.

In the event of material changes, we will inform you through the Service and, where applicable, obtain your consent.

12. Severability Clause

Should any provision of these Terms of Service be invalid, the remaining provisions shall remain unaffected.
